1. Eligibility. The Vistaprint Perfect Wedding Giveaway ("Giveaway" or "Promotion") is offered and open only to legal residents of the 50 United States or District of Columbia who are at least 18 years of age or the age of majority in their jurisdiction of residence, whichever is older, at time of entry. Employees, officers and directors of Vistaprint USA Incorporated ("Vistaprint" or "Sponsor" ), Overdrive Interactive ("Administrator"), Facebook, Twitter, their respective parent, affiliated and subsidiary companies, advertising and promotion agencies, and persons engaged in the development of Promotion materials, and members of the immediate family (parents, siblings, children and spouse, wherever they reside) or household members (whether or not related) of such employees, officers and directors are not eligible. By participating, you agree to these Official Rules and all decisions of Sponsor and/or Administrator, an independent judging and administration organization, which are final and binding in all respects. Void where prohibited.
2. Promotion Period. The Promotion begins on April 9 at 12:00:01 a.m. and ends on May 10 at 11:59:59 p.m. A day begins at 12:00:01 a.m. and ends the following 11:59:59 p.m. All times are Eastern Standard Time. The Promotion computer is the official time keeping device for the Promotion.
3. How To Participate. There are two ways to participate during the Promotion Period. Access the Promotion Web site www.vistaprintgiveaway.com ("Web site") and complete the registration fields: your first and last name, basic information about your wedding such as the wedding date and your email address. You must also confirm that you have read and agree to these Official Rules. By providing your email address you will receive one entry into the Promotion. You can also enter by providing this information at Vistaprint's Facebook page located at http://www.facebook.com/pages/Weddings-by-Vistaprint/266957704091. At the Web site, you can also complete a form with your first and last names and email address that will automatically post a message to your Twitter account. By completing the Form you are giving the Sponsor permission to make such a post. These messages will be pre-written by Vistaprint. When the message is posted to your Twitter account you will receive one entry into the Promotion. If you do not have a Twitter account you can obtain one without cost or purchase by accessing the Twitter web site and following the registration information. You may be asked to consent to receive promotional e-mails and reminder e-mails from the Sponsor. Consenting to receive promotional or reminder e-mails is optional and does not have to be agreed upon in order to be eligible to participate in the Promotion, and does not improve your chances of winning. In the event you do consent to receive these e-mails, the use of such e-mails shall be subject to the privacy policy of the Web site and you may opt out of receiving these e-mails at any time. There is a Limit of one (1) entry per entry method (providing an email address, sending a tweet) per person or e-mail address. Participants may not enter more than once per entry method by using multiple different email addresses, identities or other methods. Any participant who does so, or uses any device or artifice to circumvent these Official Rules may be disqualified and their entries disqualified.
4. Drawings. There will be one potential winner for each day of the Promotion. The potential winner for any day will be randomly selected by the Promotion administrator from all eligible entries received by the end of that day. The drawing for any day will take place on or about the day following the day for which the winner is selected. Non-winning entries from any drawing will be carried forward to subsequent drawings. Potential winners for each drawing will be notified by email, regular mail, overnight mail and/or phone on or about 2 business days after the drawing. If notification is by email, 3 attempts within 3 days will be made to contact/notify the potential winner. Should the potential winner fail to respond to the third contact/notification attempt within 24-hours of the time when it is sent, the prize will be forfeited and awarded to an alternate winner. The only warranty for any prize may be any written limited warranty, if any, that may be made by the manufacturer of the prize and delivered with the prize. If a prize winner cannot accept prize as stated, the prize will be forfeited in its entirety and awarded to an alternate winner. No substitution, cash redemption or transfer of prize is permitted, but Sponsor reserves the right to substitute the prize with a prize of equal or greater value if the advertised prize becomes unavailable for any reason. All federal, state and local taxes are the sole responsibility of the winner. Odds of winning in any drawing depend on the number of eligible entries received for that drawing.
6. GENERAL CONDITIONS: Participants agree that (a) Sponsor, Overdrive Interactive, Facebook,Twitter, their respective parents, subsidiaries and affiliated companies, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents (individually and collectively "Releasees") are released, will have no liability whatsoever for, and shall be indemnified and held harmless by participants against any liability for any injuries, losses or damages of any kind (whether due to negligence or otherwise) to person(s), including death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the prize or participation in this Promotion or any Promotion related activities, and, (b) each winner grants permission to Sponsor and those acting under its authority the right to the use of his/her name, picture, likeness, voice, biographical information and statements, at any time or times, in perpetuity, for advertising, trade, publicity and promotional purposes without additional compensation (except where legally prohibited), in all media now known or hereafter discovered or devised, worldwide, and on the Internet and World Wide Web, without notice, review, or approval. LIABILITY LIMITATIONS: Releasees are not responsible for lost, late, misdirected, incomplete, postage due or non-delivered mail, entries or e-mail; or for interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), Web site, Facebook, Twitter, telephone or other connections, availability or accessibility, or miscommunications, or failed computer, satellite, telephone or cable transmissions, or lines, or technical failure or jumbled, corrupted, scrambled, delayed, or misdirected transmissions or computer hardware or software or program/programming malfunctions, failures, or technical errors or difficulties, or other errors of any kind whether human, mechanical, electronic or network or the incorrect or inaccurate capture or transmission of registration, entry or other information or the failure to capture, or loss of, any such or similar information. Persons who tamper with or abuse any aspect of this Promotion, as solely determined by the Sponsor, will be disqualified. 9. DISPUTE RESOLUTION/CHOICE OF LAW: Except where prohibited, each entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court or the appropriate Massachusetts State Court located in Boston, Massachusetts; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Releasees in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Massachusetts without giving effect to any choice of law or conflict of law rules (whether of the State of Massachusetts or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Massachusetts.
10. SEVERABILITY: In the event any provision of these Official Rules is deemed illegal, invalid or unenforceable, such provision shall be stricken to the extent of its illegality, invalidity or unenforceability and the remainder of these Official Rules shall be construed and enforced as if it did not contain the stricken provision.
11. WINNERS LIST: For the names of the winners, print your name and complete address on a self-addressed first class stamped envelope and mail in a first class-stamped envelope to: Vistaprint Perfect Wedding Giveaway C/O Public Relations, 95 Hayden Ave, Lexington, MA 02421 for receipt by June 10, 2010. Winners may also be posted on the Web site.
